Welcome

This handbook is published by the Electoral Commission in Tongan and English languages to assist candidates. Its purpose is to explain and where necessary describe the election process and what requirements you must meet, and your responsibilities under the law. It does not replace or amend the Electoral Act 1989, (the Act) or other legislation.

It goes into some detail and where appropriate lists the Parts or Sections of the Act and related acts upon which it is based, together with any Regulations issued under the Act.

The Commission advises that you consult the Tongan Constitution, the Act, and any other legislation relating to conduct of a campaign for election, such as the Tongan Broadcasting Commission Act.

Guidance

The Commission can assist you by providing information of a general nature about the nomination process and campaign activity. It cannot provide you with formal or informal legal advice.

Candidates must satisfy themselves about their own legal positions and, if necessary, refer to the exact provisions of the Constitution, the Act and Regulations, and consult their own lawyers.
